  • Warranties regarding the accuracy, reliability, or completeness of any content
  • Warranties regarding the accuracy, safety, or quality of any products or services advertised on the Website by third-party advertisers.

Educational Content Disclaimer
As stated in our Disclaimer, all content on this Website is for educational purposes only and does not constitute professional advice. We are not liable for any decisions or actions you take based on information from this Website.

By using this Website, you acknowledge that you have read and agree to our full Disclaimer, which is incorporated into these Terms of Use.

Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, PHYSICIAN LIVING, ITS FOUNDERS, EMPLOYEES, CONTRACTORS, AMBASSADORS, PARTNERS, AND AFFILIATES SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or use
  • Business interruption or loss of business opportunities
  • Any damages arising from your use of or inability to use the Website
  • Any damages arising from User Content, third-party content, or advertisements
  • Any damages arising from unauthorized access to your account or data

This limitation applies regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise) and even if we have been advised of the possibility of such damages.

IN JURISDICTIONS THAT DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

Maximum Liability
In no event shall our total liability to you for all claims arising from or related to the Website exceed the amount you paid us (if any) in the twelve (12) months preceding the claim, or $100, whichever is greater.

10. Indemnification

You agree to indemnify, defend, and hold harmless Physician Living, its founders, employees, contractors, ambassadors, partners, and affiliates from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

  • Your use of the Website
  • Your violation of these Terms of Use

  • Your User Content
  • Your violation of any applicable laws or regulations

We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate with our defense of such claims.

11. Dispute Resolution and Governing Law

Governing Law
These Terms of Use and any disputes arising from or related to the Website shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law principles.

Arbitration Agreement
You and Physician Living agree that any dispute, claim, or controversy arising out of or relating to these Terms of Use or the Website (collectively, "Disputes") will be resolved by binding arbitration, except that either party may seek injunctive or other equitable relief in court to prevent infringement or misappropriation of intellectual property rights.

By agreeing to these Terms, you waive your right to have Disputes resolved in court by a judge or jury.

Arbitration Procedures
Arbitration shall be conducted by the American Arbitration Association (AAA) under its Consumer Arbitration Rules then in effect. The arbitration shall take place in Illinois or another mutually agreed location. The arbitrator's decision shall be final and binding, and judgment on the award may be entered in any court having jurisdiction.

Class Action Waiver
YOU AND PHYSICIAN LIVING AGREE THAT DISPUTES WILL BE RESOLVED ON AN INDIVIDUAL BASIS ONLY, AND NOT AS A CLASS ACTION, CLASS ARBITRATION, OR ANY OTHER REPRESENTATIVE PROCEEDING.

You and Physician Living agree to waive the right to participate in a class action, class arbitration, or any other representative proceeding. This waiver applies even if the arbitration rules or procedures would otherwise permit class or representative proceedings.

If any court or arbitrator determines that the class action waiver is void or unenforceable for any reason, or that arbitration can proceed on a class basis, then the arbitration provision shall be deemed null and void, and the parties agree to resolve Disputes in court.

Exceptions to Arbitration
Notwithstanding the above, either party may bring an individual action in small claims court if the claim qualifies.

Opt-Out Right
You have the right to opt out of this arbitration agreement by sending written notice of your decision to opt out to support@physicianliving.com within thirty (30) days of first accepting these Terms. If you opt out, all other terms of these Terms of Use will continue to apply, and Disputes will be resolved in court.

We reserve the right to modify, update, or replace these Terms of Use at any time at our sole discretion.
When we make material changes, we will:
